AOBRD introduction

In an effort to require the adoption of ELDs, the FMCSA tried to amend the Hours of Service regulations. This initial attempt to compel Hours of Service tracking through the deployment of ELD devices was unsuccessful in 2004 due to a court injunction.

Attempted Hours of Service Reform

Making the use of ELD devices mandatory was the goal of the second effort. A rule published in the Federal Register by the Department of Transportation gave the FMCSA the authority to mandate the use of ELDs for motor vehicle carriers who were experiencing problems with HOS legislation noncompliance.

ELD Announcement

The FMCSA had been charged with developing a rule requiring the use of ELDs after the US Congress approved the Moving Ahead for Progress in the 21st Century Act (MAP-21 Act). Along with addressing major issues regarding the possibility that electronic logging devices may be used to harass or coerce drivers, they were also obliged to conduct a research study on the optimal way to deploy them.

Congress Act

The FMCSA released the final Electronic Logging Device mandate. This contained measures to protect drivers from harassment, guidance for manufacturers on how to create compliant ELDs and the features that are necessary, and guidelines on how to track hours of service while using an electronic logging device.

The deadline for motor carriers to begin employing an electronic logging device, automatic on-board recorder, or electronic on-board recorder that has been approved.

General Compliance

It is necessary to upgrade or replace motor vehicles that are currently fitted with an Automatic On-Board Recording Device or an Electronic On-Board Recorder with an Electronic Logging Device.

To guarantee ELD compliance and enforcement, DOT and FMCSA publish regular revisions to their regulations.
