If your ELD malfunctions, you must note the malfunction, notify your carrier within 24 hours, and reconstruct RODS on paper logs for the current 24-hour period and previous 7 days until the device is repaired or replaced.
ELD malfunctions happen — knowing exactly what to do in advance can prevent an out-of-service order during a roadside inspection.
Step 1: Note the Malfunction
As soon as you notice the ELD isn't functioning correctly, document the malfunction in writing — date, time, and nature of the issue.
Step 2: Notify Your Carrier
You must notify your motor carrier of the malfunction within 24 hours, electronically or by phone.
Step 3: Switch to Paper Logs
Reconstruct your Record of Duty Status (RODS) on paper log forms for the current 24-hour period and the previous 7 consecutive days. Continue until the ELD is back in compliance.
Step 4: Keep the Annotation
During inspections while the ELD is malfunctioning, carry your paper logs and be prepared to explain the situation.
